Contraception is a basic health need for women. It enables people to wait until they are ready to be the best parents they can be before having children. Access to contraception is critical in achieving healthy families, both in medical and economic terms. Responsible, preventive contraception deserves to be at the core of every health plan. [Name of your company] management may or may not be aware of the recent US District Court ruling in the Erickson v. Bartell Drug Co. case that confirms the EEOC Policy Decision issued in December 2000. The Federal Judge's ruling and the EEOC policy decision clearly state that it is a violation of the Pregnancy Discrimination Act, which is part of Title VII of the Civil Rights Act of 1964, for an employer to provide health insurance to its employees that covers prescription drugs generally but excludes prescription contraceptives. The EEOC decision also says that, in order to avoid violating Title VII in the future, employers must cover the full range of prescription contraception. Enclosed is a copy of the decision for your review.
